Promotion of Access to Information Act, 2 of 2000
The deadline for submission of the PAIA Section 51 Manual for
existing Private Bodies is due for publication by not later than 31
August 2005. Any new Private Body must prepare and publish the manual
within 6 months after coming into existence.
A Private body is described as :

a natural person who carries or has carried on any trade,
business or profession, but only in such capacity; |
|
a partnership which carries or has carried on any trade,
business or profession; or |
|
any former or existing juristic person, excluding a public
body, such as a Ltd Company, national, provisional or local government. |
The meaning of this is that any Sole Proprietor, Partnership,
Close Corporation, Private Company or Trust is regarded as a Private Body.
Failure to publish the PAIA manual can result in penalties or
imprisonment or both if a Private Body is found guilty.
